Our Michigan truck accident lawyers advise accident victims of their legal rights. For this type of auto accident in Michigan, the family members of the pedestrian may be able to make a claim for Survivor Loss Benefits. This can include payment of funeral expenses, lost wages, and loss of other services.

In addition, the injured passenger may be able to file a lawsuit against the truck driver if he is found at fault as well as the owner of the semi-trailer.

The insurance company for the driver must still cover any injuries. In this lawsuit, the family of the deceased victim can claim damages and compensation for the injuries suffered in the accident. Also, the family members of the deceased pedestrian may have a claim for a Michigan wrongful death lawsuit against the driver that police determine was negligent and caused this accident as well as the owner(s) of the truck. Fatal Semi-Truck Accident in Michigan

I read a tragic story today about a person killed and one injured in a fatal semi-truck accident on April 1st, 2010  in Oakland County. The truck accident took place on Grand River Avenue near Napier Road in Lyon Township, on the western edge of Detroit metro area and was between a car and a semi tractor trailer.

According to the Oakland County Sheriff officers, a 28 year old man was traveling east on Grand River Avenue with a passenger when he suddenly lost control of his vehicle. The driver crossed over the center line into the westbound lane where the truck driver swerved into the eastbound lanes to avoid the collision. When the truck driver swerved to avoid the car, the driver of the car moved back into the correct lane crashing into the semi truck trailer’s back axle.

The driver sustained serious injuries and the passenger of the vehicle was prounounced dead at the scene.  I am very sorry to hear about this tragic accident and wish my most heart-felt condolences to the family of the passenger for their loss.

Detroit Suburb Truck Accident Fatality

Police continue to investigate a Michigan truck accident that took the life of a woman whose car collided with a Coca Cola truck in Plymouth Township.  Her identity has not been released.  Further details of the accident should be out shortly.

My thoughts and condolences go out to the family of this woman.  This is no doubt a tragic loss.

I am hopeful that the police perform a complete investigation of this truck accident to determine if the truck driver was at fault for the accident.  If such a determination is made, the surviving family members may be able to file a Michigan Wrongful Death Lawsuit and seek compensation for their losses.  The surviving family member can also seek Michigan No-Fault Insurance Survivor benefits to pay for funeral and other expenses.

Police Officer Killed in DeWitt Accident

I just read a tragic story online about a Clinton County Sheriff’s Deputy who died on his way to work.  The officer (whose name I will not publish) was riding his motorcycle to work and apparently struck a deer, causing him to be thrown from his bike.  Several tractor trailers were able to avoid him on the roadway but a third did not, causing his death.

My sincerest sympathies and condolences go out to his family, friends, and colleagues.  Simply put this is a devastating loss.

There are unique laws relating to motorcycle accidents in Michigan.  Had the officer died without contact from the truck and just from the deer, he would not have been entitled to Michigan No-Fault Insurance benefits.  Because his fatal injuries were apparently caused by the truck, his family would then likely be entitled to Survivor’s Loss benefits.  This includes lost wages, funeral expenses, household service payments, and other benefits.

If the truck driver should have reasonably avoided the accident, as did the two trucks in front of him, the officer’s family may be able to pursue a Michigan wrongful death lawsuit against the driver and trucking company.  Much of this will depend on the results of the State Police Investigation.
