Overloaded Trucks & Accidents

Our Michigan truck accident lawyers perform a thorough and detailed investigation when investigating a lawsuit for a truck accident victim.  To properly do this, we look to all of the potential causes of a truck accident.  This requires a careful anaylysis of the investigation report, witness interviews, photographs, and trucking company records.

One common cause is the improper loading of the truck. An improper truck load is typically one which the load is too heavy for the truck and trailer or one in which the loading is not properly balanced.  These both affect the truck driver’s ability to stop and control the truck, especially when it comes to applying the vehicle braking system.

There are federal and state trucking regulations that specify truck load weights and provide requirements for the proper loading of trucks. A complete and thorough investigation of the vehicle log, cargo weight, and other specifications is necessary to prove the causes for the accident.  Many times, it is the truck load along with driver fatigue and other factors that cause the accident.  Because the injuries caused by truck accident are typically catastrophic, it is important to hire an experienced truck accident attorney as soon as possible after the accident to begin the investigation.

Michigan Truck Accident Facts

Our Michigan truck accident lawyers represent victims of truck accidents throughout the entire State of Michigan.  Statistics show that truck accidents in Michigan are becoming even more common.  This is terrible news for motorists on Michigan roads and highways.

A review of statistics for Michigan truck accidents is disburbing.  In Michigan alone, trucks are involved in more than 13,000 accidents per year.  Trucks account for over 25% of all fatal accidents in Michigan

In 95% of truck accidents,  there was either property damage, personal injury, or death.  Based upon their sheer size and weight alone, a motorist, motorcyclist, or pedestrian has little chance of avoiding serious injury when involved in a truck accident.  The results are often catastrophic.

When a driver, pedestrian, bicyclist, or motorcyclist is hit by a truck, Michigan No Fault benefits are available to the accident victim.  No Fault benefits pay for medical expenses, lost wages, household replacement services, attendant care, and other benefits regardless of fault in the accident.   Medical benefits are unlimited and last a lifetime.

In addition, when an accident victim’s injuries are severe, the victim may have a legal claim against the truck driver if the truck driver is at fault in causing the accident.  The best way to determine what claims an injured person has is to consult with an experienced Michigan truck accident lawyer.  The lawyers at our firm have represented truck accident victims in cases involving serious injury and wrongful death and have obtained great settlements for our clients.

Wexford County Construction Zone Truck Accident

I read a story today about a serious Wexford County Construction Zone Truck Accident that occurred on US-131 just south of Cadillac. According to the Michigan State Police, a road construction worker was seriously injured when a box truck allegedly rammed into his truck in a construction zone.

State Police state that the box truck driver allegedly did not see a convoy of construction workers painting the lines on the roadway. The worker was taken to the hospital with a possible head injury.

I am very sorry to hear about this accident and wish the worker the fullest and speediest recovery possible.

Michigan truck accident victims have a number of legal rights.  As this accident happened while he was working and involved a motor vehicle,  the road construction worker may be eligible to receive Michigan Workers Compensation benefits and Michigan No-Fault Benefits. These benefits are similar in that they would cover  his medical expenses, lost wages, attendant care, replacement services, and other benefits related to injuries suffered in the accident.

In addition, the injury victim may be able to file a lawsuit against the driver and the owner of the box truck. In this lawsuit, they could claim damages and compensation for the injuries suffered in the accident.  The insurance company for the negligent driver typically pays a settlement for this type of case.

The road construction worker should speak with an experienced Michigan Accident Lawyer to determine which  benefits he is eligible to receive. Accident victims should not speak with an insurance adjuster for the negligent parties before consulting with an attorney.

U-Haul Truck Accidents

With changes in the Michigan economy and a lot of Michigan residents on the move, you can see more and more moving and delivery trucks on our streets and highways.  Many people decide to move themselves and rent trucks from companies like U-Haul.  Unfortunately, a large number of those people simple do not know how to drive those vehicles and this can lead to serious truck accidents.

Depending on the circumstances of the rental and the accident, there are a number of claims that can be made by the victim of a U-Haul truck accident.  This can include claims for Michigan No-Fault Insurance Benefits and possibly claims against both a negligent driver and against the U-Haul rental company.

Garbage Truck Accident Kills Bicyclist

A tragic story was reported about a garbage truck accident that killed an elderly man walking a bicycle.  Police are still investigating and seeking witnesses to the accident.  My thoughts and condolences go out to the victim’s family and friends.

Garbage truck accidents are much more common that most people might think.  The large trucks are on the roadways for long periods and have constant stops and starts.  Quite often, the driver is paying attention to the garbage or the actions of his partner and takes his eyes off the roadway.  This can and does have deadly results, like the accident above.
